Unemployment tops 10 percent in 16 states in June: "WASHINGTON (AP) - The U.S. Labor Department says unemployment topped 10 percent in 16 states last month. The rate in Michigan surpassed 15 percent, the first time any state hit that mark since 1984."

White House's $50B foreclosure plan a bust so far - Victoria McGrane - POLITICO.com
White House's $50B foreclosure plan a bust so far - Victoria McGrane - POLITICO.com: "Administration officials blame the mortgage servicers charged with carrying out the mortgage modifications and refinancing under the federal program. Many of their Democratic allies on Capitol Hill back them up, but others are criticizing the White House for fumbling the execution. Whatever the reason, the program hasn’t stopped the rising tide of foreclosures: Experts predict that at least another 2 million homes will be lost this year, and the administration’s plan has so far reached only about 160,000 of the 3 million to 4 million homes it was supposed to protect over the next three years."

Director’s Blog » Blog Archive » The Long-Term Budget Outlook
Director’s Blog » Blog Archive » The Long-Term Budget Outlook: "Under current law, the federal budget is on an unsustainable path, because federal debt will continue to grow much faster than the economy over the long run. Although great uncertainty surrounds long-term fiscal projections, rising costs for health care and the aging of the population will cause federal spending to increase rapidly under any plausible scenario for current law. Unless revenues increase just as rapidly, the rise in spending will produce growing budget deficits. Large budget deficits would reduce national saving, leading to more borrowing from abroad and less domestic investment, which in turn would depress economic growth in the United States. Over time, accumulating debt would cause substantial harm to the economy."

San Diego: median home price up in June
Median home price up in June: "San Diego County's median home price rose for the third consecutive month in June, hitting $314,250, the highest figure since October, and raising hopes that the region's slumping housing market may finally be poised for a comeback.
With fewer low-priced foreclosure homes on the market and growing sales of higher-priced properties, the county's median price rose $19,250 from May to June. The 6.5 percent one-month percentage gain was the biggest since MDA DataQuick began keeping records in 1988."

Foreclosures at record high in first half 2009 despite aid | Reuters: "NEW YORK (Reuters) - U.S. home foreclosure activity galloped to a record in the first half of the year, overwhelming broad efforts to remedy failing loans while job losses escalated.
Foreclosure filings jumped to a record 1.9 million on more than 1.5 million properties in the first six months of the year, RealtyTrac said on Thursday.
The number of properties drawing filings, which include notices of default and auctions, jumped 9.0 percent from the second half of 2008 and almost 15 percent from the first half of last year."

So you can imagine the 12-year-old's disappointment when her mother's homeowners association told the family to take the cross down because it was in violation of the rules.

Could we be wrong about global warming? - Science Fair - USATODAY.com: "Could the best climate models -- the ones used to predict global warming -- all be wrong?
Maybe so, says a new study published online today in the journal Nature Geoscience. What caused the remainder of the warming is a mystery."

Illinois budget: Gov. Pat Quinn, top lawmakers inch closer to stopgap deal -- chicagotribune.com: "SPRINGFIELD -- With state worker paychecks hanging in the balance, Gov. Pat Quinn and top lawmakers moved closer Tuesday to a stopgap budget agreement that includes billions of dollars in borrowing and pushing off a tax-hike vote to a more politically convenient time.
After several closed-door meetings and brief legislative sessions of the House and Senate, several lawmakers headed 90 miles down the road to St. Louis for baseball's All-Star Game and to see a ceremonial first-pitch delivered by their former colleague, President Barack Obama.
But two weeks into the state's budget year, no deal was reached among leading Democrats, Republicans and Quinn on a spending plan. With Wednesday the first major payday since the July 1 budget deadline, Comptroller Dan Hynes' office said checks to as many as 6,000 of the state's 69,000 workers would not go out."
------------------
It must be nice to ride so high, so far above the peons, that you can waltz off to a baseball game the day before 6000 state employees aren't getting paid. If there is a more miserable excuse for a legislative body in the world, I would like to hear its name.

Clothesline bill hung out to dry : News-Record.com : Greensboro & the Triad's most trusted source for local news and analysis: "Back during crossover (click here), Rep. Pricey Harrison, a Greensboro Democrat, got a little bill (H 1353) through the House that would prohibit cities and counties from adopting blanket prohibitions on clotheslines.
The idea, according to Harrison, is to allow people who want to save energy by hanging out their laundry (rather than use their dryers) even if some folks in the community turn up their nose at the idea. Originally, the bill started out as an effort to keep homeowners associations from adopting restrictive covenants prohibiting clotheslines, but Harrison took that out of the bill after getting a lot of resistance. (Related items here, here and here.)
So the bill came before the Senate Commerce Committee today … and it was doomed."

So, it is fair game on clotheslines in South Carolina.

Peter Singer: Why we must ration health care
Why We Must Ration Health Care - NYTimes.com: "The debate over health care reform in the United States should start from the premise that some form of health care rationing is both inescapable and desirable. Then we can ask, What is the best way to do it?"
-------------
Who is Peter Singer, you may be asking? He is one of the most famous ethicists in the world. His critics say that his views on many issues put him very close to advocating eugenics.
Here are some of his other views:
--all animals capable of suffering like humans should have equal rights with humans, or it is "speciesism"
--it is possible to have mutually satisfying sexual relations between humans and animals
--a fetus is incapable of having preferences, so abortion is morally permissible
--killing a newborn baby is not equivalent to killing a person who has self-consciousness and wants to go on living
And now he is advocating health care rationing, which means that if you are old and sick you will be less likely to get expensive procedures. This is exactly where Obama's health care plan will lead, of course. There is no way to expand coverage and cut costs (or even avoid runaway increases in costs), given the same number of doctors and hospitals, without rationing.
Maybe Obama can make Prof. Singer the Health Care Rationing Czar.

Randy Barnett: Sotomayor doesn't understand fundamental rights incorporation doctrine
The Volokh Conspiracy - -
The Bill of Rights as originally understood only limited the actions of the national government. But the 14th amendment, passed after the Civil War, is aimed directly at the states, and the due process clause of the 14th amendment says that no state can deprive any US citizen of life, liberty, or property without due process of law. The word "liberty" has been given specific meaning by the USSC by "incorporating" into that word certain specific liberties that are in the Bill of Rights. Which ones? The ones that are considered "fundamental."
Sotomayor has this exactly backward. She thinks you define "fundamental" by asking, "is this incorporated?" No. First the court has to decide whether it is fundamental, which is one of these difficult questions of judicial philosophy they are trying to ask her about that she won't answer. Then, if the court decides the right is fundamental, that right is incorporated.
Sotomayor is either ignorant of a basic principle of constitutional law, or she is being evasive.
Randy Barnett is one of the nation's most distinguished constitutional law scholars, and he says this: "This is both a grossly incorrect (and empty) understanding of the doctrine governing the protection of fundamental rights and an inaccurate statement of the precedents concerning the incorporation of the right to keep and bear arms into the Due Process Clause of the Constitution."

Leahy explains his "wise Latina" misquote, but the video shows... | Washington Examiner: "After the hearings were over Tuesday, I asked Leahy about the misquote. 'I was doing it from memory,' Leahy explained. 'But I knew that she would -- she stated exactly what she said, and the statement is in the record.' Leahy added that he did not consider Sotomayor's precise words very important; her response, he said, was much more critical.
That's Leahy's explanation. But video of his question is available on YouTube, and it certainly appears that Leahy was reading from a text when he misquoted Sotomayor"

It seems that after people have been in law and politics for a while they lose any connection with the idea of "the truth" as most people understand it. Instead, they think that any lie they can get away with by any means is morally indistinguishable from the truth. Leahy was lying yesterday about what she said, and now he is lying today about what he did. Yet, he is just as self-righteous as ever.

FACT CHECK: Don't quote Sotomayor on that, Senator: "LEAHY SAID: 'You said that, quote, you 'would hope that a wise Latina woman with the richness of her experiences would reach wise decisions.''
THE FACTS: If that's all Sotomayor said, the quote would barely have mattered to opponents of her nomination. The actual quote, delivered in a 2001 speech to law students at the University of California at Berkeley, was: 'I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life.'"

This is Senator Patrick Leahy (D--Mars), deliberately misrepresenting what she said, in hopes that the evening news will carry his statement instead of hers, thereby helping to defuse the controversy over her statement, and what it says about her. Everybody who runs his statement would know it is not what she said, but he's hoping they will run it anyway, because these days so many of the media are playing on the Democrat team.
This is what American politics has come to.

Obama mulls rental option for some homeowners-sources | Markets | Markets News | Reuters: "NEW YORK, July 14 (Reuters) - U.S. government officials are weighing a plan that would let borrowers who have fallen behind on their mortgage payments avoid eviction by renting their homes instead, sources familiar with the administration's thinking said on Tuesday.
Under one idea being discussed, delinquent homeowners would surrender ownership of their homes but would continue to live in the property for several years, the sources told Reuters.
Officials are also considering whether the government should make mortgage payments on behalf of borrowers who cannot keep up with their home loans, tapping an unused portion of a $50 billion housing aid kitty."
------------
Under the first plan, I wonder who they would "surrender ownership of their homes" to. Let me see. It wouldn't be...oh, THE FEDERAL GOVERNMENT, would it? Because that would instantly create a gigantic stock of public housing, and we just spent the last two presidential administrations trying to unload that nightmare.
And under the second plan, Uncle Sam just becomes Uncle Sugar.

Lenders abandoning foreclosed properties - JSOnline
Lenders abandoning foreclosed properties - JSOnline: "For years, lenders complained about debtors who left the keys on the kitchen table and skipped town, leaving it to the bank to file for foreclosure and eventually take title by buying it at a sheriff's sale.
The latest twist: Now it's the lenders who are doing the walking, often without telling the borrowers, who may believe erroneously they have already lost title.
'This is just the meanest and nastiest thing (lenders) could do,' said Catherine Doyle, chief staff attorney at the Milwaukee Legal Aid Society. 'Even more profound is the terrible damage to the community. All of us are going to have to bail them out.'"

U.S. mulling mortgage aid for unemployed | U.S. | Reuters: "NEW YORK/WASHINGTON (Reuters) - President Barack Obama is mulling new ways to delay foreclosure for jobless homeowners who are unable to keep up with monthly payments, an administration official said on Monday.
The official told Reuters it was reasonable for policymakers to consider options for loan forbearance -- allowing borrowers to delay, defer or skip payments -- that are more effective than those currently available in the private sector."
----------
But if you impair the bank's security, why should they lend in the first place? Are they just supposed to lend money and not get any loan payments? How is that a business model? I realize it sounds great to a socialist, but we are talking about the real world.

Brown Manure, Not Green Shoots - Forbes.com: "Essentially, the results today suggested that there are not as many green shoots. These green shoots, as I've argued, are mostly yellow weeds that may even turn into brown manure if a double-dip, W-shaped recession occurs in 2010-11...Home prices have already fallen from their peak by about 30%. Based on my analysis, they are going to fall by at least 40% from their peak, and more likely 45%, before they bottom out. They are still falling at an annualized rate of over 18%. That fall of at least 40%-45% percent of home prices from their peak is going to imply that about half of all households that have a mortgage--about 25 million of the 51 million that have mortgages--are going to be underwater with negative equity and will have a significant incentive to walk away from their homes."

Municipal and state governments across the country are struggling with massive budget shortfalls, leaving them in no position to fill the pension gap. Offering a tiny apology | Change of Subject
Offering a tiny apology | Change of Subject: "The question looking forward is what excuse, what explanation, what apology the Democratic Party can offer voters for making such a mess of things yet again, even with the ostensibly rogue ex-governor out of the picture. Democrats asked the voters for power in Illinois. And the majority of voters -- including me, I should say -- said OK. The result reduced legislative Republicans to decorative-plant status. But with this power came full and admittedly awesome responsibility -- to address the impact of the nationwide economic crisis and balance the state budget in a time of declining revenues. This responsibility didn't exactly creep up on the Democrats. We all saw it coming.
What did the Democratic leadership do to address this admittedly knotty problem? They bickered. They hemmed. They hawed. They quailed at making decisions and taking ownership of decisions that will inevitably prove unpopular among some segments of the population. Eventually, they ran out the clock at the end of last month and forced an overtime session."

This chart shows that dissatisfaction with the state of affairs in the US dropped from around 80% to 60% in the first four months of the Obama administration. People were swept up in the overall sense that "hope and change" were coming. But look what has happened since May. The level of dissatisfaction has gone back up steadily, and is now at 68%. This is not surprising, because unemployment has continued to climb, gas prices have gone back up, the housing market is still in the toilet, state and local budgets are horrifying, and people are worried about government debt and eventual tax increases. In other words, the hopey-changey laughing gas is blowing away in the wind of the recession.

When the street was abandoned, the private HOA refused to allow and adjoining landowner access to it. The result of the HOA’s refusal to permit access was that the landowner was unable to proceed with an 8 lot subdivision of the adjoining land."

The Hook News Blog » Blog Archive » Comer canned: Homeowners oust missing treasurer: "“The behind-the-scenes view of this is that he staged this thing and ran off,” says Tommy Stafford of Nelson County Life, the first local publication to notice the identity of the missing man. “They can’t be 100 percent sure,” says Stafford, who has conferred with several top law enforcement officers, “but things are certainly looking that way.”
Comer, whose day job is the presidency of Glenmore Country Club and who also represents the developer of the neighborhood of over 700 homes, reportedly went missing shortly after 9:30am Wednesday, July 1. That, according to a press release from the homeowners association, was less than an hour before a meeting with two association board members to discuss “incomplete data made available to the auditor.”"

Fight for HOA reform continues after bill fails | News 8 | WFAA.com: "'The issue isn’t going away,” said Rep. Burt Solomons.
The Carrollton Republican introduced legislation in the last session aimed at reining in HOAs. The bill failed to come up for a vote in the Senate.
“We intend to continue fighting,” he said. “It’s gotten out of control and it’s very hard to rein them in.”... Lawmakers say there are 30,000 homeowners associations in Texas, which has only 5,000 towns.
“You have entities that have more power than any city council,” Scott said. “More power than any city government with no checks, no balances, no accountability, no transparency, no openness.” "

This is mainly about foreclosure reform, as I understand it, and that is probably going to remain a huge issue in TX and elsewhere for the foreseeable future.

Delinquencies on home-equity loans hit record - Los Angeles Times
Delinquencies on home-equity loans hit record - Los Angeles Times: "Late payments on home-equity loans rose to a record in the first quarter as 18 straight months of job losses and a slumping economy left more borrowers unable to pay their debts, the American Bankers Association reported.
Delinquencies on home-equity loans climbed to 3.52 percent of all accounts from 3.03 percent in the fourth quarter, and late payments on home-equity lines of credit climbed to a record 1.89 percent, the group reported today. An index of eight types of loans rose for a fourth straight quarter, to 3.23 percent from 3.22 percent in October through December, the group said."

U.S. Home Prices to Fall Through 2011’s First Quarter, PMI Says - Bloomberg.com: "Thirty of the 50 biggest metropolitan areas have at least a 75 percent chance of lower prices through March 31, 2011, Walnut Creek, California-based PMI said in a report today. The decline is likely to spread to “all regions of the nation” from California, Florida, Nevada and Arizona, the states most affected by the housing slump, PMI said.

Legal Bills Swayed Palin, Official Says - NYTimes.com: "Lt. Gov. Sean Parnell of Alaska said Sunday that Gov. Sarah Palin’s decision to resign was largely prompted by the personal legal costs of the ethics investigations against her."

Think about that. Palin may have given up her political career, at least for the foreseeable future, because of the costs of legal defense. Now imagine that you are a homeowner in a CID. You have to pay your own lawyer. The association draws on the resources of all the owners. This imbalance in legal representation is one of the main sources of association power.

City of Casselberry backs down
Consumer health: Orlando Sentinel.com: "Populist outrage and plain fairness caused the Casselberry City Commission to ditch a new code requiring trucks with racks for ladders, pipe and other tools of serious work to be parked in garages or carports, which many truck owners did not have. The code had no provision for appeal or grandfathering current residents — stupid.
'Had a packed house at the commissioners' meeting,' reported plumber Mark Long. 'They canceled all enforcement on this code and decided to write a new one letting us park in the driveway if we take everything off the racks. No way this is perfect, but I don't know if we can get any more. I will keep on top of them and rally the troops if needed.' Power to the plumbers!"

Population numbers bounce back in cities - USATODAY.com: "The housing crisis and economic downturn that have forced many Americans to stay put are boosting older cities where population had been shrinking or was stagnant, according to Census estimates out Wednesday.
Last year, Los Angeles recorded its biggest annual increase since 2002 and New York its second largest this decade. Chicago, where population had declined for five years this decade, grew by 0.73%.
------------
The article offers two explanations. The lefty urban planners who think we should all abandon the suburbs and our SUVs for tiny urban condos and walking to work are convinced that this is The Sign that their apocalyptic warnings have been heeded. But the other explanation is :"Cities' rebound may be a result of people not being able to sell their homes or condos or not having jobs to allow them to leave cities."

The cuts have come as states across the country are struggling to approve budgets, and California’s governor, Arnold Schwarzenegger, declared a fiscal state of emergency on Wednesday...The federal stimulus law is channeling $100 billion to public education, and Education Secretary Arne Duncan has repeatedly urged states and districts to spend part of the money to keep schools open this summer.

Gloomy U.S. consumers clip housing recovery hopes - Yahoo! Finance: "WASHINGTON (Reuters) - U.S. consumer confidence took an unexpectedly steep slide in June, figures released on Tuesday showed, suggesting the 18-month-long recession had yet to loosen its grip on the economy.
A separate report on April house prices in major cities offered some encouraging signs that the worst of the housing slump may be over, but that was not enough to lift investors' spirits, while another crop of economic data showed business activity in New York City and the Midwest remained weak and retail chains slogged through a rough June.
Billionaire investor George Soros added to the cautionary tone, saying fears of inflation would drive up borrowing costs and choke off growth once financial markets recover."

CHA mixed-income building has class clash -- chicagotribune.com
CHA mixed-income building has class clash -- chicagotribune.com: "Low-income apartment dwellers and middle-class condo owners have shared Westhaven Park Tower since the building opened in 2006 -- an innovative setup that the city hoped would unite residents and exemplify Chicago's $1.6 billion overhaul of public housing.
Proximity, however, has not led to harmony.
The most recent skirmish inside the 113-unit midrise on Hermitage Avenue on the West Side concerned building security. Another flare-up centered on the proper use of the lobby: Public housing residents -- who make up a third of the building -- saw it as a place to hang out; condo owners did not.
Kathy Quickery, president of the building's condominium association, put it bluntly in a letter to the CHA last month: 'After living in the building for three years, I consider the project a failure for homeowners.'"
-----------------
This is one of the outcomes of the Clinton Administration's housing policy. These mixed-income developments were the result of the HOPE VI program that replaced public housing projects with places like this. Another part of the Clinton-Cisneros housing policy was expanding home ownership to the poor by forcing banks to lend to them. That worked out just about as well as the mixed-income housing concept.

States brace for shutdowns - Los Angeles Times: "Indiana is one of five states -- along with Arizona, California, Mississippi and Pennsylvania -- bracing for possible shutdowns this week as time runs out for lawmakers to close billion-dollar gaps in their fiscal 2010 budgets.
Of the 46 states whose fiscal year ends today, 32 did not have budgets passed and approved by their governors as of Monday afternoon, according to the National Conference of State Legislatures.
Although the majority of those are expected to pass eleventh-hour budgets, the fiscal futures of a handful remain uncertain, said Todd Haggerty, an NCSL research analyst."

Indiana Governor Warns Government Shutdown Possible
Indiana Governor Warns Government Shutdown Possible: "Gov. Mitch Daniels has said he was prepared to keep essential services such as public safety running if lawmakers do not pass a budget by midnight June 30, but warned that most of state government would shut down.
Daniels said he would use emergency powers to keep state police and prisons operating, and public assistance - including unemployment insurance - would keep being distributed to those already eligible. The Indiana National Guard, state Department of Homeland Security and health officials would be available on standby.
But he said state parks would not be open and Bureau of Motor Vehicle branches and other state offices would close, as would casinos and the lottery because they are regulated by the state. Most of the state's 30,900 employees would be furloughed."

Congressional Budget Office: Debt Tsunami
The Debt Tsunami - washingtonpost.com: "To put it bluntly, the fiscal policy of the United States is unsustainable. Debt is growing faster than gross domestic product. Under the CBO's most realistic scenario, the publicly held debt of the U.S. government will reach 82 percent of GDP by 2019 -- roughly double what it was in 2008. By 2026, spiraling interest payments would push the debt above its all-time peak (set just after World War II) of 113 percent of GDP. It would reach 200 percent of GDP in 2038.
This huge mass of debt, which would stifle economic growth and reduce the American standard of living, can be avoided only through spending cuts, tax increases or some combination of the two. And the longer government waits to get its financial house in order, the more it will cost to do so, the CBO says."
--------------
There is no way the national government will reach those debt levels, which are not only unsustainable but impossible, because at that point nobody will buy our bonds. Long before the federal government hits that level, our creditors--including the Chinese--will have forced the US government into virtual receivership and will be dictating our policies, on pain of no more lending.
And a government that out of control will cripple the economy. If we get this cap and trade policy, along with national health insurance, energy prices and tax rates will go so high that this recession will never end. The state and local governments are raising taxes already, and soon the higher federal taxes will suck up even more private revenues.

Clotheslines blow through culture again | Richmond Times-Dispatch: "Planned communities and condos frequently have covenants that ban or restrict the use of clotheslines. In the Richmond area, restrictions vary -- from all-out prohibition, as in Charles Glen in Henrico County, to restricted use, as in Chesterfield County's venerable Woodlake and Brandermill subdivisions.
'We do allow portable devices [drying racks], just not permanent ones,' said Brian Hoyle, community-standards manager for Woodlake, where racks must be brought inside once the laundry is dry.
With more than 300,000 community associations across the country, promoting clothesline use has been an uphill task for Alexander Lee, founder of the nonprofit Project Laundry List, which he started 11 years ago as a Middlebury College student."
