The followup story tells it differently. Apparently the father and son had already waited in line, made it to the counter, and were asked to go get a replacement for an exchange. They arrived back at the line and were waived to the counter by the clerk when the officer entangled himself. The father & son story sounds pretty believable. Many stores have a video of the returns area. Hopefully this store will have a video available to confirm exactly what occurred.
OK, but the substance of the great debate over who was first in line is completely irrelevant to the criminal charges. The only thing that matters is whether these two fellows challenged the off duty officer to fight over it, tried to drive off over him, and then fought with him.
