Reader's Watchdog: Condo group's moves have homeowners crying foul | The Des Moines Register | DesMoinesRegister.com: Some Iowa lawmakers tried to pass model legislation passed in Colorado and other states that would fix that. But state Rep. Julian Garrett, R-Indianola, told me the legislation, the Uniform Common Interest Ownership Act, died for lack of support at the end of the past session.

Until those holes are fixed and consumer protections are made stronger, Bill Brauch, who heads the state attorney general’s consumer protection division, told me he would never join a homeowners’ association.

“You have so little control over the many negative things that can happen to you,” he said. “And then you become trapped in a situation beyond your control that only continues to deteriorate.”

What model legislation was passed in Colorado?

The only thing that's been done here in years is to require HOAs to register with the Dept. of Regulatory Affairs, and set up an office that can collect complaints, but not do anything about them.

Tom Skiba's gang still controls Colorado.

The UCIOA wasn't written by attorneys representing homeowners......

The UCIOA is not the solution to any of the problems presented.

One of the chief concerns stated here was the imposition of binding arbitration for dispute resolution. How is the UCIOA going to solve that?

Another problem identified was that homeowners have no choice but to hire attorneys when things go wrong with the HOA/condo. Guess what? That didn't change with the UCIOA.

The best part of the story was when the head of the consumer protection division of the state attorney general's office stated he would never join a homeowners' association because of all the negative things that can happen to you.
