Online petition to Congress: Declare HOAs governments -- or outlaw them as rackets

Make Home Owner Associations legitimate by holding them to the same standards as our state and federal government, or end them as racketeering.

These privatized corporate goverments are judge, jury, and executioner against homeowners' basic rights. They require no oversight as they target, bully, and foreclose for profit, and just because they can. This multi-billion dollar a year industry uses oblivious HOA boards to extort billions from homeowners while proporting to "protect property values." Nothing could be further from the truth. Tragically, Senator Carona from Dallas owns the largest HOA management company in the country, and he writes the legislation against homeowners to protect his empire.

Contract Requiring or Prohibiting Homeowners Association (H.O.A.) Membership Void

A contract is void if it requires that, to own a home, homeowners or applicants for home ownership:

(1) must be or may not be members of an H.O.A. ; or

(2) must remain or may not remain members of an H.O.A.


The Right-To-Own-Your-Own-Home would allow homeowners to opt-out of the association at any time, without fear of having to give up their home.

This proposal is not a radical idea; it is based on existing law.

Compare the proposed law prohibiting mandatory membership in an H.O.A. union as a condition of home ownership to an existing law prohibiting mandatory membership in a labor union as a condition of employment:

A contract is void if it requires that, to work for an employer, employees or applicants for employment:

(1) must be or may not be members of a labor union; or

(2) must remain or may not remain members of a labor union. (Enacted 1993.)

TX Senator –
We the people would like to remind you that no State has the right to delegate away through State legislation the inalienable rights (life, liberty, and estate (property) of any US citizen. On this issue the States have no rights and because you don’t understand this fact you are not qualified to be a State legislator or any person of authority.

Considering that the growth of H.O.A.s was encouraged by the Federal Housing Authority since the 1960s, federal legislation to protect homeowners is wholly appropriate. (among other reasons)

Earlier this year, Republicans introduced federal "Right To Work" legislation. Senator Bullbleep and his fellow travelers didn't object.

I rise to offer the following amendments to the petition:

Whereas the proponents of HOAs say they are necessary in order to protect residential real estate property values;

Whereas home values have fallen by 50 percent since 2006 in areas of the United States with large numbers of HOAs;

Whereas HOAs have failed to protect property values and may have accelerated their decline with their grossly overappraised cookie cutter McMansions;
