Scottsdale HOA takes on Steven Seagal
Another HOA decides to create physical obstacles to entry. This time, though...they are messing with the star of a whole series of movies that had three things in common: 1) They all had "kill" or "death" in the title; 2) they all included some major league butt-whipping; 3) they all star Steven Seagal.

The name of the HOA management company is conspicuously omitted from the story....
"Another HOA decides to create physical obstacles to entry."
Did they block entry to the driveway, or just block parking in front of the property?
From the video (at 1 min. 47 sec.), it doesn't look like the driveway is blocked.
FYI: For anyone who followed this link from another web site, and is wondering about the reference to "another HOA," see privatopia.blogspot.com/2011/06/hoa-at-lexington-crossing-flickr-photo.html and privatopia.blogspot.com/2011/06/car-blocked-in-driveway-by-hoa.html
Now I'm really getting hungry to sue an HOA...this tops the other potential case posted here where the HOA put concrete blocks in some potential client's driveway.
The video at 1:00 clearly shows that the driveway is not blocked.

Carefree Ranch Homestead Estates is managed by Preferred Communities, Alan Hatch Community Manager and Manager of Preferred Communities, LLC.
http://www.gothoa.com/home.html
“Our commitment to you is to provide excellent customer service to each Board member and to each homeowner in your community. Preferred Communities credo is to act in a reasonable manner and exercise proper business judgment in all areas. We never supersede the Board’s power in the community, rather, we will advise the board of proper business judgment.” Preferred Communities
Safety First! (Excerpted from Volume 1, Issue 1, April 2011, The Ranch Homesteads Newsletter:
“The roads within the community can be very dangerous. The roads are narrow and winding. They were never designed to accommodate pedestrian traffic. Therefore, extreme caution must be exercised while driving and any pedestrian traffic should be restricted to areas of adequate visibility to protect the safety of both driver and walker. There have been a number of near misses due to neglect on both sides.
Please avoid walking or bicycling in the middle of the road within the community. The community has a maximum speed limit of 30 mph when road conditions permit. Remember, wet roads can cause unsafe driving conditions. Use caution at all times.”
Assuming, as with Lexington Crossing, Sandy Springs, GA, “Car Blocked in Driveway by HOA" (See http://privatopia.blogspot.com/), “The HOA was advised by their legal team to do this,” can anyone spell derivative fiduciary liability?

I think this is retaliation for his article in Urban Lawyer exposing "The Public Role in Establishing Private Residential Communities", and his radio interview with Shu about the subject.
