MyFox Tampa Bay | Homeowners face foreclosure for bushes, fees: "A group of homeowners say they face liens on their homes and possible foreclosure for something as trivial as tall bushes. Others say they're accused of not paying fees when they have. Now, the issue is headed to court."

Donald R Peyton as well as many of the HOA's he represents should be ashamed of themselves. This is just another fine example of self serving HOA Boards & A Greedy Scumbag attorney..Foreclosing on homes for petty violations and small sums of back fees is a DISGRACE..Fla. LAW MAKERS WAKE UP and look into these Out of control HOA'S . The attorneys that represent these horrible HOA's are laughing..ALL THE WAY TO THE BANK. And people are LOSING THEIR HOMES. KH

I can see no legitimate reason for these groups to even have the power to enforce things that can normally be addressed at the county level..as taxpayers we all fund our county court system and can if need be use local ordinances for problems with fences, shrubs, non- running cars,litter, etc. no one should be threatened with foreclosure over any of these types of issues..

AS OF AUGUST 19, 2008, WE HAVE $8,881.24 IN OUR CHECKING ACCOUNT

AND $53,513.36 IN OUR MONEY MARKET ACCOUNT FOR A TOTAL OF $62, 394.60 IN OUR OPERATING ACCOUNTS. OF THAT $22,363.88 IS PAID IN ADVANCE MONEY SO WE HAVE $40,030.72 TO LAST US THE REST OF AUGUST & SEPTEMBER.


AS OF THIS DATE, WE HAVE 71 MEMBERS WHO HAVE NOT PAID THEIR ASSESSMENT. SEVENTEEN MEMBERS ARE IN MORTGAGE COMPANY FORECLOSURE, 6 BWEHA LIENS RECORDED, 2 BWEHA FORECLOSURES WITH THE REMAINING IN VARIOUS BWEHA STAGES OF COLLECTION

Ya just gotta love an HOA that is worried about the county slapping them with maint. violations because THEIR OWN PROPERTY IS OVERGROWN..and yet will file lien & foreclose on a homeowner that has a few shrubs that MAY be higher than 5ft...or for a pile of sticks/branches left on the ground after trimming ! I'll stay in New Joisey..thank ya verra much! Beacon Woods East Property Manager’s Report: There is an area of the retention area which comes up to Clayton and then comes around in back of the clubhouse. This area has become very overgrown. She talked with our lawn care man who also does the bush hogging for us. She would like to get this area worked on - it is too overgrown for the lawn care man to do much with it now, when he is bush hogging the retention area. She added that there are some other areas which we will have to address in the future since it is our responsibility. The lawn care man will clean up this area for an added cost of $500. She would like Board approval to go ahead with this work. It would involve taking down some trees and removing the undergrowth. In discussion, Mr. Kingsbury felt that was a lot of money - and, in order to get a better idea of what was needed, the meeting was recessed and the Board went out to examine the area in question.


Upon the Board’s return, the meeting was again called to order. Mr. Kingsbury expressed the feeling that, if we cleaned up this area, we might be liable to clean up other sections of the retention areas. Mrs. Frick explained that, in the case of retention areas which are the responsibility of the Association it is our duty to maintain - otherwise the County can issue a code violation.
